MOO has teh funneh!

Got funny cat picture? Check. Got the right font? Check. Got funny caption? Meh... No. Harder than it looks, isn't it? Never mind. Lolcats are here, and they totally haz a flavor! Get Ready Made Greeting Cards or Postcards or mix it up and choose 'em yourself, in the mixy-uppy section.

There's more. We've also got these brilliant cards by Someecards. You might have to send them with extreme caution (there's a bit of swearing) and both the Seasonal Greeting Cards and the Postcards are drier than you could ever imagine. But hey - your friends have the same sense of humour as you right? That's why you get on?

I'm starting to get the same feeling when I see these cats as when someone writes "teh funnies" or "omg!!!1one" and so on, which is really unpleasant.

I hate to be a downer, but has this all been cleared for copyright issues? I suspect most of the owners of these pics or the text on them might not be too worried about them being posted on ICHC, but selling merchandise with their work on them without a contract could be legally problematic. Might want to double-check on these. I'd hate to see either ICHC or Moo get sued over one of these.

TOS at ICHC states:

For clarity, you retain all of your ownership rights in your User Submissions. You also hereby grant each user of the Website a non-exclusive license to access your User Submissions through the Website, and to use, reproduce, distribute, display and perform such User Submissions as permitted through the functionality of the Website and under these Terms of Service.

That only applies to user submissions, though, not older stuff that existed before that agreement. And it also doesn't apply to any photos--like the lolrus ones--that weren't taken by the person who wrote the caption or sent it in. Photographers retain copyright for all their photos unless they specifically waive it.

But don't the TOS also state that you don't send in a photo unless you have taken it and/or have permission to use it? In which case, it would be the sender-inner (lol) who would be breaching copyright?

Could they be considered a derivative work, and then arguably be alright under fair use?

Nope. Fair use is really hard to argue, especially in the case of merchandise.

It is, I was just assuming that Moo would have some legal advice before considering submissions of that sort.

But I did actually misinterpret your original comment, I took it that you were referring only to the original photographs that the images are based on. The risk of someone submitting an image they didn't make would be a different situation and has nothing to do with questions of fair use, of course.

Yes, we did take legal advice. The images are covered under ICHCB terms of service, and our agreement with them. They have assured us that they have the rights to allow us to print the images.

derivative works are only okay under certain Creative Commons licenses, not under regular copyright.

I don't think that's quite the case, but certainly without a CC license the process of legally establishing fair use is a notoriously muddy area.
